While technically other dispensaries could locate within Creswell, the 1000 foot buffer, as defined in the measure, leaves a small number of much less desirable locations in which a competing dispensary could operate. Furthermore, the wording of the measure provides an exception to the 1000 foot rule only for “companies of common ownership”, which would provide the sponsor of this measure a massive competitive advantage.
